These general terms of sale are concluded on the one hand between the Hirundo Rustica association whose
registered office is located at Ti an Holl, 7 place d’Auvelais, 22310 Plestin-les-Grèves / Siret n° 481 558 377 00026 / code APE 9001Z, managing the website www.hirustica.fr and the online sale of the CDs of the Hirustica label and, on the other hand, any natural person or legal entity wishing to make a purchase via the website www.hirustica.fr hereafter named as “the buyer”.

Article 1. Object

These conditions of sale aim to define the contractual relationship between Hirundo Rustica and the buyer and the conditions applicable to any purchase made through the website www.hirustica.fr

The acquisition of a product through this website implies unreserved acceptance by the buyer of these conditions of sale which the buyer acknowledges having read before placing his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site www.hirustica.fr is not directly related to his professional activity and is limited to strictly personal use and on the other hand to have the full capacity legal, allowing it to engage under these general conditions of sale.

Hirundo Rustica keeps the possibility of modifying these conditions of sale at any time, in order to stick to any new regulations or in order to improve the use of its site. Therefore, the applicable conditions will be those in effect on the date of the order by the buyer.

Article 2. Products

The products offered are those which appear on the store of Hirustica label on the www.hirustica.fr website, within the limits of available stocks. Hirundo Rustica reserves the right to modify the products at any time. Each product is presented on the website by means of a description showing its main technical characteristics. The photographs are as accurate as possible but do not bind the seller in any way. The sale of products presented on the website www.hirustica.fr is intended for all buyers residing in countries which fully authorize the entry into their territory of these products.

In the event of an order to a country other than mainland France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights aren’t the responsibility of Hirundo Rustica. They will be your responsibility, both in terms of declarations and payments to the competent authorities and entities in your country.

Article 3. Prices

The prices appearing on the internet catalog are prices in Euros (€) all taxes included (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. Hirundo Rustica reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated don’t include delivery costs, invoiced in addition to the price of the products purchased according to the total amount of the order.

Article 4. Availability

The products offered on the website are for sale as long as they are online and while stocks last. The availability indicated at the time of consultation of the website by the buyer remains dependent on the actual state of the stock at the time of registration of the order. It may happen that the product is no longer available between the time of the order and the moment of its recording by Customer Service.

If a product turns out to be unavailable after the order, Hirundo Rustica will inform the buyer as soon as possible by mail, e-mail or telephone and will give him the possibility:
– either to be reimbursed for the price of the product ordered,
– or to be delivered, a product of a quality and a price equivalent to the ordered one.

Article 5. Order and payment terms

Any order appearing on our website implies acceptance of these General Terms of Sales. Any order confirmation entails your full acceptance of these General Terms of Sales, unreservedly and without exception.

All the data provided and the recorded confirmation will constitute proof of the transaction. The order confirmation will be worth signature and acceptance of the operations carried out. A summary of your order information will be sent to you via the order confirmation email address.

The fact of validating your order implies for you the obligation to pay the indicated price. The payment for your purchases is made through the Paypal system.

Article 6. Property reserve

Hirundo Rustica keeps full and entire ownership of the products sold until the price has been fully collected, costs and taxes included.

Article 7. Retractation

In accordance with the regulations in force, the right of withdrawal can’t be exercised on vinyls, CDs, DVDs or any audio or video medium when they have been unwrapped or unsealed;

Under Article L121-20 of the Consumer Code (French Law), the buyer has a period of fourteen working days from the delivery of his/her order to exercise his/her right of withdrawal and thus return the product to the seller for exchange or refund without penalty, except for the cost of return.

For any product exchange or refund request as part of the right of withdrawal and for any question or information relating to the right of withdrawal, the buyer must contact Customer Service by e-mail 

The buyer must take care of the product(s) intended for return as long as they are in his/her possession.

 

In case of exercise of the right of withdrawal within the aforementioned period, and if the returned product (s) have not been damaged by the Purchaser, the association will proceed, at the choice of the buyer, to the exchange or reimbursement of the price of the Product purchased and returned, within 30 (thirty) days of receipt of the product.

The Customer must return, at his expense, and in its original condition, the product together with the name of the person who ordered the product as well as the order number to the following address:

If the entire order is returned, Hirundo Rustica will reimburse the amount of the order, namely the purchase price of the product concerned and the amount of the initial shipping costs on the basis of the invoiced price. The reimbursement will be made after checking that the terms set are met.

Article 8. Delivery

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographic area. Orders are made by La Poste. Delivery times are only indicative. In accordance with legal provisions, in the event of late delivery, you have the option of canceling the order under the terms and conditions defined in article L 138-2 of the Consumer Code (French Law). If you receive the product in the meantime, we will reimburse it and cover the shipping costs under the conditions of article L 138-3 of the Consumer Code (French Law).

The risks associated with transport are the responsibility of the buyer from the moment the items leave the premises of the label. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

Article 9. Guarantee

All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, provided for by articles 1641 and following of the Civil Code (French Law). In the event of non-compliance of a product sold, it may be returned, exchanged or refunded.

All complaints, requests for exchange or refund must be made by e-mail or mail within 30 days of delivery.

The products must be returned to us in the condition in which you received them.

Article 10. Responsability

The products offered comply with current French legislation. The responsibility of Hirundo Rustica can’t be engaged in the event of non-compliance with the legislation of the country where the product is delivered. Furthermore, Hirundo Rustica can’t be held responsible for damage resulting from improper use of the product purchased.

Finally, we can’t be held liable for all the inconveniences or damages inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.

Article 11. Intellectual property

All elements of the www.hirustica.fr website are and remain the intellectual and exclusive property of Hirundo Rustica. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the website whether in the form of a photo, logo, visual or text.

Article 12. Personal data

Hirundo Rustica undertakes to preserve the confidentiality of the information provided by the buyer, which he/she would have to transmit for the use of some services. Any information concerning him/her is subject to the provisions of Law No. 78-17 of January 6, 1978 (French Law). Therefore, the Internet user has the right to access, modify and delete information concerning him/her. He/she can request it at any time by mail or e-mail.

Article 13. Litigation

These distance selling conditions are subject to French law. For all disputes or litigation, the competent court will be the court of Saint-Brieuc (22, France).

Article 14. Diverse

Hirundo Rustica intends to safeguard under reasonable security conditions the precedence of each order and each payment made on the website. In the event of a dispute or fraud, the association will therefore be able to produce as evidence all the archived elements that it has in its possession.
